Saladworks®: “Original Costume Contest”

NO PURCHASE NECESSARY. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.

Sponsor and Administrator

The sponsor of the Promotion is Saladworks, Inc., 1001C Conshohocken State Road, Conshohocken, Pennsylvania 19428 (“Sponsor”).  The administrator of the Promotion is Traffic Marketing, LLC, 417 N. 8th Street, Philadelphia, PA 19123  (the “Administrator”). 

Eligibility. 

Saladworks®: “Original Costume Contest” (the “Promotion”) is open only to legal residents at least eighteen (18) years of age of the states where Saladworks has store locations: Alabama, Arkansas, California, Colorado, Delaware, Georgia, Indiana, Kentucky, Maryland, Minnesota, North Carolina, New Jersey, New York, Ohio, Pennsylvania, Rhode Island, Tennessee, Texas, Virginia and West Virginia, except where prohibited or void (“Entrant(s)”).  Employees of Saladworks, Inc., Traffic Marketing, LLC (doing business as Think Traffic) and any of their direct or indirect parent and affiliate companies, as well as the immediate family and household members of each such employee are not eligible.  By participating in the Promotion and/or accepting any Prize, each Entrant agrees to be bound by these Official Rules (“Official Rules”) and the decisions of the Sponsor, which are final and binding on all matters relating to the Promotion.  Winning a prize is contingent upon fulfilling all requirements set forth herein.

Promotional Period

The Promotion begins on October 26, 2020 at 11:00 a.m. Eastern Time and ends on October 31, 2020 at 11:59 p.m. Eastern Time (the “Promotional Period“). The Administrator’s (as defined below) computer will be the official time-keeping device for this Promotion.

Prizes

There is one single Grand Prize winner.  The Grand Prize receives a prize package with fifty-two (52) Saladworks regular salads during a calendar year (“Grand Prize”) with a retail value of $570 and a Saladworks swag bag containing a Saladworks T-Shirt, a Saladworks Hat and a Saladworks Pop Socket.  ONE (1) Grand Prize will be awarded in connection with the Promotion.  One second place winner will receive a Saladworks gift card with a value of $250 and a Saladworks swag bag containing a Saladworks T-Shirt, a Saladworks Hat and a Saladworks Pop Socket.  ONE (1) second place winner will be awarded in connection with the Promotion.  ONE (1) third place winner will receive a Saladworks gift card with a value of $100 and a Saladworks swag bag containing a Saladworks T-Shirt, a Saladworks Hat and a Saladworks Pop Socket. ONE (1) third place prize will be awarded in connection with the Promotion.

How to Enter

The Promotion offers Entrant two (2) ways to enter. There is a limit of one (1) entry per person, regardless of method of entry. All entries must be in compliance with these Official Rules, including, without limitation, the Submission Guidelines (“Submission Guidelines”) detailed below.  Proof of submission of entry does not constitute proof of delivery or entry during the Submission Period.  All entries become the property of Sponsor and will not be returned.  Incomplete entries, entries by script, macro or other automated means, or entries that do not fully comply with these Official Rules, including without limitation, the Submission Guidelines, or which subvert the entry process, in the sole discretion of Sponsor, will not be eligible.  All entries must be received during the Sweepstakes Period to be eligible.  The computer clock of the administrator is the official timekeeping device.

  • Via Instagram:An Instagram account is required for this method of entry and can be opened for free by downloading the Instagram application from the Apple store or Google Play. Entrants must have their account settings set to public and be a follower of the Saladworks’ account at @Saladworks. To enter, during the Sweepstakes Period, via an Instagram account, a web-enabled mobile device (e.g., iPhone/iPad/iPod Touch, Android, etc.) (each, an “Eligible Device”), and Internet access is required for entry. If you don’t already have an Instagram account, visit http://www.instagram.com/ to create one.  Please note that you must agree to comply with the Instagram Terms of Service (http://instagram.com/legal/terms/) in order to create your Instagram account.  It is free to create an account.  To enter, during the Sweepstakes Period, you must post a photo to your Instagram Feed or Instagram Story of your original costume with hashtag #SaladworkOriginalCostumeContest. Entrant is not required to be wearing costume in submission but must have permission of person or parent/guardian of minor in photo to submit. Pets are also accepted in contest entry.
  • Via Direct Message: An Instagram account is required for this method of entry and can be opened for free by downloading the Instagram application from the Apple store or Google Play. Entrant is not required to be wearing costume in submission but must have permission of person or parent/guardian of minor in photo to submit. Pets are also accepted in contest entry.

This Sweepstakes is in no way sponsored, endorsed or administered by, or associated with Instagram. You understand that you are providing your information to Sponsor, and not to Instagram. By participating in this Sweepstakes, each entrant will be subject to the Instagram Terms and Conditions (http://instagram.com/legal/terms/) and Privacy Policy (https://help.instagram.com/519522125107875). Please read these terms and policies before entering.

Limit

Each Entrant is limited to only one (1) entry per email address.  Multiple Entrants are not permitted to share the same email address or Rewards Mobile App account and each Entrant is limited to only one (1) Rewards Mobile App account.   Any attempt by any Entrant to obtain more than the stated number of entries will void that Entrant’s plays and that Entrant may be disqualified.  Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible, or misdirected registrations, which will be void.  In the event of a dispute as to any registration or play, the authorized account holder of the Rewards Mobile App account or email address used to register will be deemed to be the Entrant. The “authorized account holder” is the natural person assigned an email address by an internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Potential winners may be required to show proof of being the authorized account holder.

Selection of Winners

A panel of judges will review all of entries received during the Promotional Period and will select the (3) entries based on originality and creativity, design, photo submission and other elements in the panel’s sole discretion. The three (3) entries will be announced on November 4, 2020 on Saladworks.com/OriginalCostume and various social media outlets.

The potential winners will be notified by direct message to the social media account the potential winner used to submit the Finalist Submission entry.  The potential winner must respond to Sponsor’s notice within forty-eight (48) hours after the time of notice or else that potential winner may be disqualified.  The potential winners may be required to execute and return an affidavit of eligibility, a liability release and, unless prohibited by law, a publicity release and other related documents required by the Contest Entities (the “Prize Claim Documents”), within a reasonable amount of time, as determined by the Contest Entities in their sole discretion. The potential winners will not be eligible to receive a prize until all properly completed Prize Claim Documents are received.

The Contest Entities shall have no liability for any winner notification that is lost, intercepted or not received by a potential winner for any reason. If any potential winner (i) does not respond within the time required by Sponsor (including, without limitation, if the winner notification is returned as unclaimed or undeliverable), (ii) is found to be ineligible, (iii) has not complied with these Official Rules, or (iv) declines the prize for any reason , such potential winner will forfeit his or her prize and an alternate winners may be selected based on the selection process set forth above.

Verification of Winners

The Potential Winner will receive specific redemption instructions via email or through the Rewards Mobile App and must redeem the Prize pursuant to the instructions on or before November 8, 2020.  Prizes are non-transferable and have no cash equivalent unless required for by law.  Sponsor reserves the right to substitute a Prize for one of equal to or greater value if the designated prize should become unavailable for any reasonable.  Winners are responsible for all taxes and fees associated with Prize receipt and/or use.  The Prize winner will receive an annual IRS Form 1099 for each tax year where the total value of the prize redeemed is equal to $600.00 or more.  Odds of winning the Prize will depend on the number of Entrants that entered to win.

All potential winners are subject to verification before any Prize will be awarded. Receiving a Prize is contingent upon compliance with these Official Rules. Each potential Original Contest winner will be sent an email to the email address associated with the Entrant and required to sign and return a Declaration of Compliance, Liability Waiver and where not prohibited a Publicity Release (“Verification Documents“) and an IRS Form W-9 which must be received by Administrator, within three (3) days of the date notice or attempted notice is sent, in order to claim the Prize.  If a potential winner of any Prize cannot be contacted, or fails to sign and return the Verification Documents, tax forms or any other requested information within the required time period, the potential winner forfeits the Prize.

Unclaimed Prize winners will not be awarded.  In the event that a potential Prize winner is disqualified for any reason or is not awarded during the Promotional Period, Sponsor will award the applicable Prize to an alternate winner by random drawing among all eligible Entrants.

The Winner will be posted after winner confirmation is complete.

General Rules

The Promotion is governed by and subject to the laws of the United States.  All applicable federal, state and local laws and regulations apply.   This Promotion is void where prohibited by law.  Neither Sponsor nor Administrator is responsible for any typographical or other errors in the printing of the offer, administration of the Promotion, or the announcement of the prizes, or for lost, late, misdirected, damaged, incomplete or illegal entries.

Sponsor reserves the right at its sole discretion to disqualify the Entry of any individual found to be: (a) tampering or attempting to tamper with the entry process or the operation of the Promotion or any Sponsor website; (b) violating the Official Rules; or (c) violating the terms of service, conditions of use and/or general rules or guidelines of any Sponsor property or service.

Caution: Any attempt by an Entrant or any other individual to deliberately damage any website or undermine the legitimate operation of the Promotion may be a violation of criminal and civil laws. Should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law.

Release

Any Prize winner agrees to release and hold harmless Sponsor, Administrator and each of their respective direct or indirect parents, subsidiaries, affiliates, related entities, suppliers, distributors, advertising/promotion agencies and each such entity’s officers, directors, members, employees, contractors, and agents from and against any and all losses, liability, illness, injury, claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Promotion or receipt, possession, use or misuse of any prize.

Publicity; Privacy Policy

Except where prohibited, participation in the Promotion constitutes entrant’s consent to Sponsor’s and its agents’ use of winner’s name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes worldwide, in perpetuity, in any and all media, manner, and formats now known or hereafter devised, without further payment or consideration.

Entrant’s personal information is subject to the Sponsor’s Privacy Policy located at Saladworks.com/Privacy-Policy.

Limitation of Liability

Sponsor assumes no responsibility for any computer, online, telephone transmission or technical malfunctions that may occur during participation in the Promotion including, without limitation, any error, omission, interruption, deletion, defect, delay in operation of transmission, failures or technical malfunction of any telephone network or lines, computer online systems, servers, providers, computer equipment, software, email, players or browsers, whether on account of technical problems, traffic congestion on the Internet or at any website, or on account of any combination of the foregoing.  If, for any reason, the Promotion is not capable of running as planned including, without limitation, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Promotion and select winners from among that portion of the Promotion that has not been compromised, if any. Sponsor reserves the right to cancel this Promotion at any time without obligation or prior notice.

Disputes; Governing Law

Except where prohibited, as a condition of participating in this Promotion, Entrants agree that any and all disputes which cannot be resolved between the parties, claims and causes of action arising out of or connected with this Promotion, any prize awarded, or the determination of Winners shall be resolved individually, without resort to any form of class action.  Further, in any such dispute, under no circumstances will an Entrant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental or consequential damages, or any other damages, including attorneys’ fees, other than Entrant’s actual out-of-pocket expenses (e.g. costs, which does not include the value of time spent, associated with entering this Promotion), and Entrant further waives all rights to have damages multiplied or increased.

All issues and questions regarding rights and obligations of Entrants in connection with this Promotion shall be governed by, and construed in accordance with, the laws of the Commonwealth of Pennsylvania, without giving effect to the conflict of laws and rules thereof and any matters or proceedings which are not subject to arbitration as set forth in these Official Rules and/or for entering any judgment on an arbitration award, shall take place in Philadelphia County, Pennsylvania.

The parties waive rights to trial by jury in any action or proceeding instituted in connection with these Official Rules and/or this Promotion.  Any controversy or claim arising out of or relating to these Official Rules and/or this Promotion shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association.  Any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party.  The arbitration shall be conducted in the Commonwealth of Pennsylvania and judgment on the arbitration award may be entered into any court located in Philadelphia County, Pennsylvania, having jurisdiction thereof.
